La Cour pénale internationale (CPI) a émis un mandat d’arrêt contre le chef terroriste, Iyad Ag GHALY, pour des supposés ’’crimes de guerre et crimes contre l’humanité’’ commis au nord du Mali entre janvier 2012 et janvier 2013.
Figure de proue du mouvement terroriste au Mali et au Sahel, Iyad Ag GHALY n’a jamais été retrouvé ; malgré l’intervention des forces internationales au Mali. Quelles sont les chances pour mettre la main sur le chef terroriste ? Les autorités actuelles de la transition doivent-elles faire confiance à la justice internationale ?
Les juges de la Cour pénale internationale (CPI) ont rendu public ce vendredi 21 juin 2024, un mandat d’arrêt contre l’un des principaux chefs djihadistes du Sahel, pour crimes de guerre et crimes contre l’humanité. De l’avis de la CPI, ils auraient été commis ces crimes, pour l’essentiel, dans la légendaire ville de Tombouctou, au Mali, entre janvier 2012 et janvier 2013, selon le communiqué de la CPI.
Depuis le lancement de ce mandat, nombreux sont les observateurs qui s’interrogent sur l’opportunité de cette décision de la justice internationale.
Alors que le mandat avait déjà été lancé en 2017, le regain d’intérêt des juges de la CPI, plusieurs années après la mise en accusation laisse peu de place à la pertinence, la sincérité et l’efficacité de cette action judiciaire quand on sait que les crimes ont été commis il y a plus de 10 ans.
L’annonce par la Cour pénale internationale (CPI) d’un mandat d’arrêt à l’encontre du chef d’un groupe armé au Mali souligne la nécessité pour les autorités maliennes de renforcer les efforts visant à rendre justice pour les crimes graves commis par toutes les parties belligérantes, a déclaré Human Rights Watch.
Mais de l’avis du Dr Ahmadou TOURE, chercheur en sciences politiques, Paix et Sécurité au Mali, il s’agit d’effets d’annonce de la part de la communauté. Pour lui, ce mandat est purement politique et stratégique.
D’ores et déjà, le 28 novembre, la justice malienne avait déjà ouvert une enquête pour terrorisme contre ces leaders terroristes, notamment Iyad Ag Ghaly et Amadou KOUFFA.
A cela s’ajoute, dit-il, la montée en puissance de l’armée ; sans oublier les patrouilles mixtes des forces de l’Allaince des Etats du Sahel créées par le Mali, le Niger et le Burkina Faso en vue de mutualiser leur effort contre les forces du mal.
Enfin, il a souligné la ratification de l’accord de coopération militaire entre le Mali et la Russie par le Conseil des ministres le 20 juin 2024.
Au regard de ce qui précède, le lancement de mandat pose un problème de timing. Et la question que l’on se pose est de savoir est-ce que la Cour peut faire arrêter Iyad qui a échappé à la vigilance des forces pendant dix ans de présence au Mali.
En tout cas, compte tenu du contexte actuel, on voit mal comment les autorités maliennes vont arrêter Iyad et la remettre à la CPI alors que la justice nationale a déjà pris le dossier en main.
Au regard de la place qu’occupe la crise malienne dans la géostratégie mondiale, on est fondé à croire que la CPI constitue un prétexte pour la communauté internationale, particulière occidentale, de s’inviter dans le dossier.
De ce fait, la coopération avec la CPI peut être un piège pour le gouvernement, compte tenu des pressions actuelles sur le Mali et sur l’armée malienne concernant la question des droits de l’homme.
Car, en vertu du droit international, il incombe au gouvernement malien de garantir la justice pour les crimes les plus graves.
Surtout que la pratique a démontré que le mandat d’arrêt international de la CPI concerne les exactions, les meurtres et dictatures et autres crimes contre l’humanité, généralement commis dans les pays du tiers monde. Ce qui fait que les mandats d’arrêt de la CPI sont appliqués aux dirigeants des pays les moins puissants militairement.
Cette situation fait croire à des observateurs avertis qu’à la suite de Iyad Ag GHALY, des mandats similaires de la CPI pourraient être émis contre des dirigeants militaires maliens actuels.
En tout cas, nous avons vivace à l’esprit les sanctions américaines contre la hiérarchie et certains officiers maliens en juillet 2023.
Ces sanctions visent trois gradés de l’armée malienne, à savoir : le colonel Sadio CAMARA, ministre de la Défense ; le colonel Alou Boi DIARRA et le lieutenant-colonel Adama Bagayoko, tous deux responsables dans l’armée de l’air.
Dans un communiqué, Washington avait déclaré avoir fait «de preuves montrant que ces responsables maliens ont contribué aux activités malveillantes du groupe Wagner au Mali», dans un communiqué du Trésor américain.
Pour rappel, Iyad Ag GHALY dirige le Groupe de soutien à l’islam et aux musulmans (GSIM), lié à Al-Qaïda, qui opère au Mali, au Burkina Faso et au Niger et est accusé d’innombrables attaques contre les armées nationales et d’exactions contre les populations civiles.
Chef rebelle touareg radicalisé, aussi connu comme « Abou Fadl », il avait fondé en 2012 le groupe Ansar Dine qui a envahi et occupé Tombouctou.
