Les fonctionnaires hospitaliers bénéficient du droit de grève, qui leur est reconnu par la loi. Cela vaut également pour les agents contractuels de droit public. Ce droit est toutefois logiquement encadré, pour assurer la continuité du service public de soins. Le mouvement de grève qui touche les services d’urgence des établissements publics met souvent en évidence les difficultés d’organisation du service minimum. En d’autres termes comment concilier la nécessaire défense des intérêts professionnels, dont la grève est un moyen, et la sauvegarde de l’intérêt général auquel la grève peut être de nature à porter atteinte.

Ainsi, il peut être nécessaire de limiter le droit de grève au nom de la continuité du service public, le secrétaire général du ministère de la Santé et du Développement social a adressé une correspondance aux directeurs généraux des hôpitaux et au directeur général de la santé et de l’hygiène publique relative à la gestion du préavis de grève de la Plateforme des syndicats de la santé du Mali (Plasma).

La continuité du service public de santé doit s’entendre d’un service minimum, et non d’un service normal avec continuité pleine et entière de ce service, car sinon le droit de grève ne serait que virtuel. En cas de grève, il convient de préserver la continuité du service public hospitalier.
