Sur le rapport du ministre de l’Economie et des Finances, Alousseni Sanou, le Conseil des Ministres a adopté, ce 11 Septembre 2024, un projet de décret portant modification du Décret n°2016-0801/P-RM du 20 octobre 2016 fixant les conditions d’acceptation d’une transaction avant la mise en œuvre de l’action judiciaire dans le cadre des poursuites pour infraction à la règlementation des relations financières extérieures des Etats membres de l’Union Economique et Monétaire Ouest Africaine.
« Le Décret du 20 octobre 2016 découle de l’application des dispositions de la Loi n°2016-007 du 17 mars 2016 portant loi uniforme sur le contentieux des infractions à la règlementation des relations financières extérieures des Etats membres de l’UEMOA.
L’article 4 dudit décret dispose : ‘’ …le ministre chargé des Finances est tenu de recueillir l’avis de la Commission du contentieux des infractions à la réglementation des relations financières extérieures, avant de se prononcer sur la demande de transaction, lorsque l’infraction, la tentative d’infraction ou l’incitation à l’infraction à la réglementation des relations financières extérieures porte sur une somme ou une valeur égale ou supérieure à cinq cent millions (500 000 000) de francs CFA… ‘’ », précise le ministre malien des finances .
Selon lui, en plus de cette exigence, aux termes de l’article 7 du même décret, le seuil de la transaction ne peut être inférieur au 1/5 de la somme ou valeur sur laquelle a porté l’infraction ou la tentative d’infraction à la règlementation des relations financières extérieures des Etats membres de l’UEMOA.
« Dans le cadre de l’audit des sociétés minières, il a été constaté des faits qui peuvent constituer des infractions au sens des dispositions législatives et règlementaires en vigueur. Le projet de décret, adopté, modifie le Décret n°2016-0801/P-RM du 20 octobre 2016 pour permettre un traitement correct des infractions constatées et préserver les intérêts économiques et financiers essentiels de l’Etat et du secteur minier », ajoute-t-il.
