 Le 10ème Forum Mondial de l’Eau, dont la cérémonie d’ouverture a été présidée par le Président indonésien, M. Joko Widodo, s’est tenu à Bali en Indonésie du 18 au 25 mai 2024, sur le thème : « L’eau pour une prospérité partagée ». La cérémonie d’ouverture a connu une série d’interventions du Président du Conseil Mondial de l’Eau, des partenaires du secteur Eau et du Président indonésien. De nombreuses personnalités venues de plus de 120 pays ont pris part à ce Forum qui a abrité des sessions ministérielles, des side-events et des activités d’exposition sur l’eau et l’assainissement.

Financés par WaterAid, les représentants de la CN-CIEPA, de la Direction Générale de la Santé et de l’Hygiène Publique (DGSHP) et d’autres acteurs du secteur ont pris part avec succès à ce Forum Mondial de l’Eau. Il ressort clairement des données que la reconnaissance de l’eau comme droit fondamental au Mali a été l’une des priorités de plaidoyer pour la CN-CIEPA/WASH, WaterAid, World Vision, ACF et d’autres partenaires du WASH.

C’est pourquoi, lors de ce Forum, l’une des interventions en side-event a porté sur le thème : « Droits humains à l’eau reconnus dans la nouvelle Constitution du Mali ». Il a été clairement détaillé par le Directeur Exécutif de la CN-CIEPA/WASH, M. Boureïma Tabalaba, qui a rappelé des données 2024 de l’UNICEF faisant ressortir qu’alors que 80 % de la population malienne a désormais accès à des sources améliorées d’eau potable, ce chiffre diminue considérablement dans les zones rurales, où il n’est que de 70 %.

Elles précisent que le déplacement dans les zones touchées par le conflit au Mali a encore limité l’accès des familles en déplacement à l’eau potable et à l’assainissement. Parlant du contexte juridique favorable, M. Tabalaba a mentionné que le Mali a reconnu et ratifié plusieurs traités et conventions internationaux contraignants ou non, qui reconnaissent le Droit à l’Alimentation de façon implicite et explicite comme partie intégrante des « Droits de l’Homme ».

Pour lui, l’adoption d’une nouvelle Constitution le 25 février 1992 a été l’occasion pour le Mali de s’engager sur la voie de l’Etat de droit, de la démocratie pluraliste et de la décentralisation, en favorisant la participation des communautés au processus de développement du pays, en général, et de leurs localités. A ses dires, dans cette Constitution, le Mali réaffirme son engagement à la Déclaration Universelle des Droits de l’Homme du 10 décembre 1948, à la Charte Africaine des Droits de l’Homme et des Peuples du 27 juin 1981 et aux autres instruments juridiques régionaux et internationaux pertinents.

LE DROIT DES POPULATIONS MAIS PAS DROIT A L’EAU

En outre, selon M. Tabalaba, le Mali s’est engagé à promouvoir tous les droits des populations et particulièrement ceux de la femme, de l’enfant et des autres personnes ou groupes vulnérables à travers les stratégies et politiques en cours. Cependant dans la foulé de cette grande révolution, le Droit à l’alimentation et à l’eau n’a pas été consacré de façon explicite, il est resté dilué dans les droits sociaux.Cela a expliqué, à ses dires, le plaidoyer de la société civile pour la constitutionnalisation de ces droits.

RESULTATS DES ACTIONS DES OSC ET LEURS PARTENAIRES

Il ressort des explications du Directeur Exécutif de la CN-CIEPA/WASH que : l’alimentation et l’eau ont été reconnues dans la nouvelle Constitution du 22 Juillet 2023 de la République du Mali (article 10) ; l’assainissement a été reconnu dans la nouvelle Constitution de la République du Mali (Article 22) ; la nouvelle Constitution a amélioré la législation nationale en faveur de ces sous-secteurs ; la constitutionnalisation de l’alimentation, l’eau et l’assainissement garantit l’ancrage institutionnel des services, ce qui favorisera une augmentation du budget alloué.

Le Directeur Exécutif de la CN-CIEPA/WASH a mis l’accent sur : l’instabilité politique (changement de régime politique, de décideurs, de parlementaires, etc.) ; la durée du processus de plaidoyer dépassant le cadre d’un programme classique habituel ; la discontinuité des acteurs durant le processus pour faute de financement ; la nécessité de l’adoption rapide d’une loi organique pour une application effective de ces droits.

Selon M. Boureïma Tabalaba, il s’agit de : faire porter les activités de plaidoyer par les organisations de la société civile fortes en termes de compétences, de ressources financières et d’engagement ; développer des mécanismes de maintien des acteurs concernés dans le processus pour amplifier les voix ; plaider auprès du gouvernement pour l’adoption de loi organique pour matérialiser ces droits sur le terrain.
